Texting & Driving Laws
In recent years, distracted driving has become a serious issue throughout the United States, and many individuals have sustained serious injuries as a direct result of someone else’s negligence. Cell phone use, especially texting, while driving is one of the most common distractions reported as the cause of auto and truck accidents.

If you or a loved one has been seriously injured in a distracted driving accident, you have legal recourse.

Legal Response to Distracted Driving

In an attempt to prevent further accidents and serious injuries, many states have enacted texting while driving laws that prohibit the use of hand held cell phones while operating a motor vehicle. According to the U.S. Department of Transportation:

  • 39 states, the District of Columbia, and Guam have passed laws that ban text messaging for all drivers.
  • Twelve text messaging bans were passed in 2010.
  • 10 states, the District of Columbia and the Virgin Islands have distracted driving laws prohibiting the use of handheld cell phones while driving.
  • Local municipalities throughout the country have also passed laws banning cell phone use for some or all drivers

The Texas legislature passed a total texting ban in 2011 which was tragically vetoed by Governor Rick Perry, an irresponsible act sure to lead to future injuries and wrongful deaths.

The Insurance Institute for Highway Safety also reports that 7 states, including Texas, have banned texting while driving for novice drivers and 3 states, including Texas, prohibit school bus drivers from texting while operating their vehicles.
